Terms of Service (EULA)

1. Acceptance

By downloading, installing or using Fio you accept these terms and the Privacy Policy. If you don't agree, don't use the app.

You must be at least 16 years old to create an account.

2. License to use

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to install and use Fio on devices you own or control, for personal, non-commercial use.

You may not copy, modify, decompile, reverse engineer, resell, rent or redistribute the app, except to the extent the law expressly allows.

3. Your account

You are responsible for keeping your credentials confidential and for everything that happens in your account.

The data you enter must be accurate: Fio's calculations depend on it.

Let us know if you detect unauthorized access.

4. Acceptable use

Don't use Fio for anything illegal, to infringe third-party rights, or to upload offensive content or content that isn't yours.

Don't try to access other people's accounts, overload the service, scrape data automatically or bypass technical limits.

We may suspend or close accounts that break these rules.

5. Your content

What you upload (meal photos, routines, notes) remains yours.

You grant us a limited license to store, process and display it to you, solely to provide the service. That license ends when you delete the content or your account.

6. Health notice — important

Fio is a tracking and educational tool, not a medical device and not a medical service.

The calories, macros and estimates it shows are approximations and may contain errors.

Nothing you see in Fio is medical, nutritional or personalized training advice. Consult a qualified professional before changing your diet, starting an exercise program, or if you have any medical condition.

If you have or have had an eating disorder, talk to your health professional before using a calorie-counting app.

If you feel a serious symptom while training, stop and seek medical attention.

7. Service availability

We do our best to keep Fio available, but there can be maintenance, outages or changes to features.

We may modify, suspend or discontinue features. If we discontinue the service, we'll give reasonable notice and you'll be able to export your data.

8. Purchases and subscriptions

If we offer paid features in the future, they are purchased through the App Store or Google Play and are also governed by those stores' terms.

Renewals and cancellations are managed from your Apple or Google account.

Refunds are handled by the corresponding store according to its policy.

9. Intellectual property

Fio, its name, logo, design and code belong to us or our licensors and are protected by intellectual property laws.

These terms do not transfer any rights over them beyond the license to use.

10. Warranties

The app is provided "as is" and "as available", without warranties of accuracy, fitness for a particular purpose or uninterrupted operation.

This does not affect the rights your country's law grants you as a consumer and that cannot be excluded.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect damages, data loss, lost profits, or health decisions made based on information in the app.

Our total liability is limited to the amount you paid us in the 12 months before the event, or USD 50 if you paid nothing.

12. Termination

You can stop using Fio and delete your account whenever you want from Profile → Settings → Delete account.

We may close your account if you breach these terms, with notice unless the severity or the law prevents it.

13. App stores

This agreement is between you and Fio, not with Apple or Google. They are not responsible for the app or its support.

Apple and Google are third-party beneficiaries of this agreement and may enforce it against you.

Using Fio also means complying with the terms of the store you downloaded it from.

14. Changes to the terms

We may update these terms. If the change is material, we'll notify you in the app before it takes effect. Continuing to use Fio afterwards means you accept them.

15. Governing law and contact

These terms are governed by the law applicable at Fio's domicile, without prejudice to the mandatory consumer protection rules of your country of residence.
